Welcome to Dynavium. These Terms & Conditions govern your access to and use of https://dynavium.com, including our website, digital services, and online store.

By accessing our website, placing an order, or purchasing a service from Dynavium, you agree to these Terms & Conditions. If you do not agree with these terms, please do not use our website or purchase our services.

1. About Dynavium

  • Website design and development.

  • E-commerce website development.

  • Search engine optimization (SEO).

  • Website speed optimization and maintenance.

  • Logo, branding, and graphic design.

  • Social media management and content creation.

  • Blog writing and promotional video editing.

  • Other digital services listed on our website.

The availability, scope, and specifications of each service are described on the relevant product or service page.

2. Eligibility and Acceptable Use

By using our website or purchasing our services, you confirm that you are legally capable of entering into a binding agreement under applicable law.

You agree not to:

  • Use our website for unlawful, fraudulent, or misleading purposes.

  • Attempt to gain unauthorized access to our website, systems, or accounts.

  • Upload malicious software or harmful content.

  • Violate intellectual property rights or the legal rights of others.

  • Provide false information or misuse our ordering and payment systems.

We reserve the right to restrict access to our website or services where reasonably necessary to protect our business, customers, or systems, subject to applicable law.

3. Services and Deliverables

We make reasonable efforts to describe our services, pricing, features, and deliverables accurately.

Unless expressly included in a service description or agreed in writing, services do not automatically include:

  • Domain registration or website hosting.

  • Paid themes, plugins, fonts, stock images, or third-party subscriptions.

  • Advertising budgets or paid promotional campaigns.

  • Ongoing maintenance or support after the agreed service period.

  • Additional revisions, features, pages, or work outside the agreed scope.

Any additional work may require a separate quote and your approval before we proceed.

4. Orders and Project Acceptance

Placing an order through our website constitutes a request to purchase the selected service.

We may contact you to clarify requirements, confirm project details, request necessary materials, or verify payment before beginning work.

An order may be declined or cancelled where there is a legitimate reason, such as a pricing error, suspected fraud, unavailable service, or inability to fulfill the request. If payment has already been collected for an order we cannot fulfill, we will arrange an appropriate refund in accordance with our Refund Policy and applicable law.

Project timelines generally begin once the required payment, content, access credentials, and project instructions have been received, as applicable to the service.

5. Pricing and Payments

Prices are displayed on the relevant service pages and at checkout. Unless explicitly stated otherwise, prices are quoted in the currency displayed at checkout.

We may update service prices from time to time. Price changes do not automatically alter the price of an already confirmed order, except where an adjustment is agreed with the customer or required to correct an error in accordance with applicable law.

Payment must be completed using the available payment methods unless alternative arrangements have been agreed in writing.

You are responsible for providing accurate billing and contact information. We may delay work while a payment is pending, declined, disputed, or awaiting verification.

Applicable taxes, transaction charges, or other fees will be disclosed where required.

6. Customer Responsibilities

To help us deliver services efficiently, you agree to:

  • Provide accurate project information and clear instructions.

  • Supply required text, images, branding assets, and other materials on time.

  • Provide necessary website or platform access through reasonably secure methods.

  • Confirm that you have permission to use all materials supplied to us.

  • Review drafts and deliverables and provide feedback within a reasonable timeframe.

  • Respond to requests for clarification or approval.

Delays caused by missing information, late feedback, or unavailable third-party services may affect delivery dates.

Customers should not send passwords, payment card security codes, or other highly sensitive credentials through ordinary email or public contact forms.

7. Delivery Timelines

Estimated delivery dates are provided in good faith and may depend on project complexity, customer cooperation, third-party services, and the availability of required materials.

We will make reasonable efforts to meet agreed timelines. However, unless a specific deadline has been expressly agreed in writing, estimated dates are not guaranteed.

If a significant delay occurs, we will make reasonable efforts to communicate the situation and discuss an appropriate next step.

8. Revisions and Changes

The number of revisions, where applicable, will be specified in the relevant service description or project agreement.

A revision generally means a reasonable adjustment to work already delivered within the original agreed scope.

Requests that introduce new features, substantially change the original direction, or require additional work may be treated as a new task and charged separately after your approval.

We may request consolidated feedback to help avoid unnecessary delays.

9. Digital Products and Intellectual Property

Unless otherwise stated in a written agreement:

  • You retain ownership of original content and materials you supply, subject to any third-party rights.

  • Upon full payment, ownership or the agreed usage rights in final custom deliverables will transfer to you as specified in the service agreement.

  • Dynavium retains ownership of its pre-existing tools, reusable components, working methods, templates, and internal materials.

  • Third-party fonts, images, themes, plugins, software, and other assets remain subject to their respective licences.

  • Drafts, unused concepts, source files, and editable project files are not automatically included unless the service description or written agreement provides otherwise.

You may not resell, redistribute, or commercially exploit Dynavium’s pre-existing materials or third-party assets in ways that violate applicable licences or agreements.

10. Website Development and Third-Party Services

Website projects may depend on third-party hosting companies, domain registrars, plugins, themes, payment gateways, APIs, or other platforms.

Dynavium is not responsible for outages, policy changes, discontinued products, security incidents, or service failures caused by third-party providers beyond our reasonable control.

Any ongoing maintenance, updates, backups, security monitoring, or technical support must be included in your purchased service or covered by a separate agreement.

Customers are responsible for maintaining their own account access and complying with the terms of third-party platforms they use.

11. SEO and Digital Marketing Disclaimer

SEO, advertising, and digital marketing outcomes depend on factors beyond our control, including competition, search engine algorithms, platform policies, budgets, customer behaviour, and website history.

Dynavium does not guarantee specific search engine rankings, website traffic, sales, leads, advertising performance, or revenue unless a particular written agreement expressly provides otherwise.

We aim to deliver the services described in the applicable service scope using reasonable professional care.

12. Cancellations and Refunds

Cancellation requests and refund eligibility are governed by our separate Refund Policy, which forms part of these Terms & Conditions.

Because digital services may involve research, planning, design, development, or other work beginning soon after an order is confirmed, the applicable refund amount may depend on the work completed and the terms agreed for the service.

Nothing in these Terms & Conditions removes any consumer rights that cannot lawfully be excluded or restricted.

Please review our Refund Policy before purchasing a service.

13. Confidentiality and Customer Information

We will handle personal information in accordance with our Privacy Policy.

Where a project involves confidential business information, both parties should take reasonable steps to protect that information and use it only for the agreed project purposes, subject to applicable legal obligations.

Customers are responsible for ensuring they have the authority to share any information, files, or access credentials supplied to Dynavium.

14. Limitation of Liability

To the extent permitted by applicable law, Dynavium will not be liable for indirect or consequential losses arising from the use of our website or services, including loss of anticipated profits, sales, business opportunities, or data, where such exclusions are legally permitted.

We are not responsible for losses caused by inaccurate customer-provided information, unauthorized customer changes, or third-party services beyond our reasonable control.

Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful, including any liability that cannot legally be excluded under applicable law.

15. Indemnity

To the extent permitted by law, you agree to be responsible for claims, losses, or reasonable expenses arising from your unlawful use of our services, infringement of third-party rights through materials you supply, or material breach of these Terms & Conditions.

This provision does not apply to the extent a claim results from Dynavium’s own unlawful conduct or other circumstances for which you cannot legally be held responsible.

16. Privacy and Cookies

Your use of our website is also governed by our Privacy Policy, which explains how personal information is collected, used, and protected.

Our website may use cookies and similar technologies to support essential functions, improve the user experience, and operate services such as the shopping cart and checkout.

Please review our Privacy Policy for further information.

17. Suspension and Termination

We may suspend or terminate access to our website or a service where reasonably necessary due to unlawful activity, security risks, fraud, or a material breach of these terms.

Where appropriate and legally permitted, we will notify you and provide an opportunity to resolve the issue.

Termination does not remove payment obligations already incurred or any rights and remedies available under applicable law.

18. Changes to These Terms

We may revise these Terms & Conditions to reflect changes to our business, services, website functionality, or legal obligations.

Updated terms will be published on this page with a revised date. Changes will apply as permitted by applicable law. Any material changes affecting an existing project will be handled in accordance with the relevant agreement and applicable legal requirements.

19. Governing Law and Disputes

These Terms & Conditions are subject to applicable laws and regulations. Where legally permissible, disputes will be addressed first through good-faith communication in an effort to reach a reasonable resolution.

The governing law and appropriate jurisdiction should be confirmed based on the legal location of the business and the rights of customers under applicable consumer protection laws.

Nothing in this section deprives a consumer of mandatory protections or rights available under applicable law.
